Question: Is there a criminal offense involved if my spouse recd money from the IRS & is lying in divorce docs?
ok, I had a student loan that went into default because my husband wouldn’t let me pay it(long story), last year they took our WHOLE tax refund check. He told me he filed an injured spouse claim, but it was denied. So now we are in process of divorce and he is stating in court papers that I owe him his half back because he never got it. I have contacted the US Dept of Ed, the collection agency (trying to get my loan paid now that we’re seperated) and now the IRS as well, & found out he actually DID receive that money back. If nothing else, he’s commited perjury, but is there any other criminal offense here, i.e. extortion or some sort of fraud? There is also already a harrassment case pending against him and they have issued a protective order due to other incidents. I’m already in the process of requesting docs from all 3 agencies & the IRS is sending me a form to research it or get copy of the check, etc. But they’ve already told me a check was issued & the amount, etc
