Former IRS Attorney

Question: Do I have to give my ex boss SS and what will happen with taxes?
I was working as a bookkeeper for an attorney for about a year+….who never took out taxes and claims all his employees are indep.contract….so last year I never got a 1099 even after I requested it for months!
So this year I left my job b/c hes a prick and verbally abuses all his employees…not to mention hes a very untrust worthy person…so another former employee reported him to the IRS b/c she said we are not really suppose to be Indep.Contract but employees and all he wants is for us to pay his fees….is that true? So now he’s bugging me for my info and SS to do the 1099…can I get introuble if I dont give to him? I dont want him to know that person info-I dont trust him!!! Can I do something about the taxes???….Im a full time student, single mom….I only worked part-time and believe me the pay was not great at all!!! Please answer all questions if possible!!! THANKS EVERYONE!!!
Answer: The old independent contractor thing. There are generally at least two or three posts a day her on that issue.
Some employers try to get around paying employment taxes (social security and unemployment) and other employee benefits like workers compensation insurance by improperly classifying employees as independent contractors. The basic issue is the amount of control the employer has over the worker. If you are required to show up for work–personally–at a particular time, punch the clock, use the employer’s equipment and are paid an hourly rate, or another set rate based on time served, you are an employee. If you didn’t understand the difference when you posed your question, I would be even more convinced that you are an employee. What is your preference, Slotted or Phillips? Complete an IRS Form SS-8 to get an official ruling on your status. This will help you get unemployment if you get fired. When you file your income tax return, you can attach Form 8919 Uncollected Social Security and Medicare Tax on Wages and only pay the employee’s half of social security. You will still have to cough up all the income tax. IRS and the states are stepping up enforcement in this abuse area.
Your employer will need your Social Security Number to properly report you earnings.

IRS Dispute Form

Question: What tax form do I need to file to dispute a claim that I was a subcontractor?
A company that my boyfriend worked for a while ago listed him as a subcontractor when they filed their taxes, causing him to owe money to the IRS (since he filed as an employee and did not have any “write offs”). The thing is, he showed up at the company, used their uniforms, equipment, etc…clearly falling short of what a subcontractor is defined as…
I guess there is a form he needs to file to dispute the company’s claim that he worked as a sub, but I’m not sure what it is called, and can’t find anything on google.Any help appreciated; sources a plus!
Answer: Get IRS pub 1779 and read it carefully.
Then have your boyfriend submit an SS-8. The IRS will review his side of the story and the payer’s side of the story. If the IRS agrees with your boyfriend, he can amend his return to move the money to the wage category and get back the 7.65% that was the employer’s share of fica/mc. This could reduce the amount he owes.
