Question: Dealing with an IRS revenue officer?

The IRS initially said I had a month to turn in the 4 years of returns I didnt file. Now they changed and said it has been assigned to a revenue officer. I called them today and they told me to mail them my four returns. She asked me alot of questions-how much I made(I am on unemployment right now) did I own a car(just repo because I was laid off and now job). I dont know how to handle this. I want more time to do my returns but she wont let me. So can I file a return and then amend it? I think I owe about 15k. What type of structured payment plan can I expect? Do I have to agree to the structured payment plan right then and there? I am intimidated by this process and want to be more informed once I turn my returns in. Any advice?




Answer: The IRS people are in the business of collecting taxes and returns. But they also have to follow guidelines, and be courteous. If you think they are not courteous, ask to speak with their manager.

Taking the issues:
She can demand the returns. That is her right, and her job. However, you can always file. The law states that the IRS can prepare “substitute” returns if you do not produce them. But after, you can prepare “original” returns for reconsideration. If she still has your case, when you submit them, that is extra work for her.

Before you can get a payment plan, an Installment Agreement, you have to be current in all your tax filings. So preparing your returns is still step #1.

She has authority, if you don’t anger her too much (she is presumably human) to grant any installment agreement that will pay off in 5 years or less if you owe less than 25K. She can grant higher installment agreements with managerial approval. You can submit form 9465 requesting one. Then it will be YOUR proposal.

Another job they are doing is getting financial information. This is also necessary for an Installment agreement. (But not strictly necessary less than 25K, again, be nice to your Revenue Officer.) She will use this information to either determine if you have an ability to pay,how much can you pay, or if you don’t pay, where to take your assets.

Request they not file the tax lien, and request penalty abatement. She may or may not grant your request, but it does no harm to try.
