IRS 1120s Mailing Address

Question: Mailed the IRS 1120S return to the state address by mistake. What will happen?

Yesterday was the last day to get business taxes out in the mail. The accountant filled out the forms for the business I work for and I had to mail them and relaized after all of the forms were out that I mailed one of the 1120S forms (which are supposed to go to the IRS) out to the state address by mistake. They have 4 different companies that I had to mail out the forms for so it is impossible for me to know which company form was mailed out incorrrectly. Will the state mail my 1120s form back to me? And if so- will my employer be penalized for filing late once I recieve the form back from the state and mail it to the IRS? Any info would be appreciated and I live in NY if that helps.




Answer: It is highly unlikely that the state will mail back the form you speak of. They will discard it as a “not required” filing for the state. You employer is likely to be penalized for late filing of the form even if someone at the state took the time to mail it back.
