Question: Why did we not get our 2009 house buyers tax credit?

My husband and I filed Married filing Jointly. We also bought a house last year, but it was only in my husband’s name because my credit was bad. He has not owned a house in over 3 years. We just received our tax refund, minus the $8,000 tax credit. Was told by the IRS that we would receive a letter explaining why in a couple of weeks. I would really like to know now. Any help would be great…THANKS!

Question: Does California not pay a tax refund if filing more that three years late like the IRS?

I just caught up on all my taxes for the last four years (I had all refunds or no taxes). Now for my 2004 Federal taxes I was too late to get my fed refund because they only go back 3 years for refunds. My question is whether there is a similar expiration to California refunds, if the year of that refund has not been filed by a certain time.

Answer: California Revenue and Taxation Code section 19306 provides for a four (4) year limit from the date that the tax return should have been filed or in the case of an amendment four years from the date that the original return was filed. Filing a late 2004 California return would get you a refund if you overpaid. You should also file the federal return although you will not get a refund.

Question: “Where’s My Stimulus” on irs.gov states my refund will be deposited on 5/9. Could it deposit sooner?

I am just curious. I am trying to get an idea of when it might deposit…will be be on the 9th, or could it be Tuesday or Wednesday. 5/6 or 5/7? Thanks!

Question: How do I get the IRS to refund my tax overpayment?

I received a notice several weeks ago that I owed some money to the IRS for my 2007 taxes. After a little investigation, I determined that they were right and I had made a mistake on my 2007 return. I sent a check in for the amount owed, it was cashed by the Treasury, and I have a copy of the cancelled check. Unfortunately, I completed my return for 2009 at about the same time, and the IRS deducted the amount owed for 2007 from my 2009 refund. So, I have now paid the delinquent 2007 taxes twice.

Any ideas how I get the IRS to pay me back for the overpayment? I visited the local Taxpayer Advocacy office, and the completely uninterested, probably incompetent “advocate” told me there was nothing she could do and it would all eventually work itself out and I would get repaid. I am VERY skeptical. Thanks for any advice.

Answer: The taxpayer advocate was right, just be patient and it will eventually work itself out. The IRS is flooded right now processing this year’s returns and refunding overpayments is not high on their priority list. Give them time and they will eventually recognize the double-payment and issue you a check.
