Question: If my ex-wife’s attorney makes a mistake that costs me money, what options do I have?

My ex-wife was to have had a quit-claim deed executed to give me full ownership of the house. Well, she signed and notarized, I signed and notarized, and it went to her attorney to run it around the government offices. He made it to the Assessor, to the Auditor, but then took a detour before making it to the Recorder and went straight to the Township Assessor! So, this quit-claim, while putting me on the tax rolls, managed to somehow never be recorded. The situation is costing me money. I am not able to refinance through a specific FHA refi program without a quit-claim being at least six months registered. Any other program would have a substantially higher cost for me. In addition, due to all kinds of complicated nonsense, I am not able to switch to a more reasonably priced home insurance until I refinance and get my ex-wife off. All told, this could cost me thousands of dollars, plus my attorney’s fees. Who do I go after for compensation, ex-wife, her attorney, both?

Answer: Why have you not discussed this with your attorney? After all, that’s what you’re paying him for. If he’s any good, he should have all the answers for you and what route you should take.

Question: Deployment readiness for military spouse (power of attorney, DEERS)?

My husband is in the Marine Corps. and deploying to Afghanistan Sept. 20th 2009. Our baby boy is due Dec. 11th.

1) I understand that I need to update with DEERS that he will have a new dependent. Is there any other place I need to update this with besides Tri-care? Do I have to go to IPAC? Also, I am confused as to if he will be paid for the new dependent?

2) I have a general power of attorney for my husband, but have been reading that this is not enough if I need to handle loan accounts that I am not on, or to be able to sell his vehicle while he is gone, handle insurance policies, file his income tax return etc. If I get a “special” power of attorney each of these items has to be listed? I thought that in the state of Texas a general power of attorney meant that I could handle anything on his behalf.

Answer: You will need a Specific POA that allows you to talk to the loan company, the bank, to sell and purchase a vehicle and anything else. This might be allowed by a Specific Financial POA but sometimes they will require one for each item. A General POA will not work when it comes to financial matters.

With having a child you will need to have a Specific POA to talk to Personnel/IPAC and have the child entered as his. It will be beyond Tricare itself. He doesn’t get any more money for having a child unless you are at an Overseas location where he gets OCONUS COLA for all of you. That is the only time it would make a difference in how many dependents there is.

Question: can i reduce my child support in louisiana?

hello here is my story, im 30 with 5 kids 9,8,7,5,3 year old my oldest one im paying support for my other four kids live with me and my wife at home,every time i go to court support increase ofcourse i dont have an attorney ,but i was informed that the court goes according to a chart and my bills or my expenses at home would not help ,how ever i make a bout 40k a year and 5400.00 a year for support thats is a bout 108.00 a week out my check,wich after a nother 120.00 for tax and 60.00 for insurance dosnt live me but 450.00 a week ,and i know if i get second job support will increase due to the chart , so is there any way i can get reduction ???

Answer: You can petition family court for a modification of your child support order. You do not necessarily need a lawyer for this. Just write a letter to the Child Support Enforcement Agency describing your circumstance & request a modification. I’m sorry that you are in this situation, just don’t forget that your oldest son may suffer because you lower your payments. $432 a month for child support, isn’t that much. Regardless of your expenses, he still needs food, shelter, clothing, childcare…. I don’t need to go on. You have kids, and know how expensive they are. Maybe your wife should pick up a part time job.
