Question: Will the IRS hold my 2008 refund if they sent me a CP2000 notice for 2007?

I received a Cp2000 notice on 1/5/09 from the IRS stating that I owed them 11000 for stock sales that I didnt claim on my 2007 return. I didnt include the sales on that return because I had losses on all of them. At any rate, I filled out a corrected schedule d for 2007 and checked the box on the cp2000 “that i do not agree with the proposed changes” and sent it back to them. Moving on, my question is: If i have a Tax refund coming to me for 2008, will the IRS hold my refund because they are currently auditing my 2007 return?
1 day ago – 2 days left to answer.
But from what i have been told, the cp2000 is a notice of proposed changes and not a notice that my income has changed for 2007. If i sent in the corrected schedule D, why should, or would they hold my 2008 refund?

Answer: You should not file your 2008 return until you clear up the 2007 issue. File for an extension if necessary.
