Question: If I file Head Of House Hold and I am still married will I be audited by the IRS?

My husband and I are still married but do not live together any more. He moved out early last year May 2009. We do not have a legal seperation or any divorce proceedings. In fact he come to the house to get his mail from the mail box but that is it. We have 3 children that I have full responsibility for. Can I claim all my kids and file HOH? I am just worried that I will be audited by the IRS. Any help would be appreciated. Thank you.
To those who answered so far, yes we lived apart for more than 6 months out of the year. May 2009 to current.

If I were to be audited, what would I have to have to show that I did support my children. As I said my husband didn’t change his address nor did we change bank accounts or anything like that. I have my paystubs, and all bills are in my name that I pay from a joint checking account which also shows my direct deposit from my paycheck.

Answer: If you are telling the truth here, there is no problem with filing head of house hold, and he should file married filing separately to avoid the chance of being audited. The one of you, who will file married filing separately should provide the name of the other spouse, social security number on line 3 of 1040

Answer: Just send them an “amended” tax return. I did that last year and they fixed it right away and got the correct refund (it was less). It was no problem.
